Richard Epstein: Trump Helps the Environment by Enraging Environmentalists

Professor Richard Epstein wrote and submitted comments on the case for updating the National Environmental Policy Act (NEPA) on behalf of ConservAmerica to the White House Council of Environmental Quality on March 10, 2020. On July 30, he authored a compelling op-ed in the Wall Street Journal.

“Environmentalist critics work on the flawed assumption that the longer the review period, the greater the environmental protection. But thatʼs untrue for the large majority of important projects. As I detail in a report for ConservAmerica, these new projects typically replace older, more dangerous projects and use superior technologies unavailable generations ago,” Epstein wrote.

ConservAmerica today welcomes the Trump administration’s update to the rules governing how federal agencies implement the National Environmental Protection Act (NEPA).

The revisions will ensure that public infrastructure and important economic projects aren’t delayed to the point that they “wither on the vine” because of an unnecessarily burdensome environmental review process, said Brent Fewell, ConservAmerica general counsel.

This update to NEPA’s rules, which have remained more or less unchanged for 50 years, is long overdue. And it’s a change that business leaders and environmentalists alike should embrace.

ConservAmerica Public Comments on Proposed NEPA Regulations

ConservAmerica today submitted written comments on the White House Council on Environmental Quality (CEQ) proposed revisions to the regulations implementing the National Environmental Policy Act (NEPA).

It has been more than 40 years since CEQ’s rules implementing NEPA have been revised. In that time, the NEPA environmental review and permitting process has become increasingly complex and time-consuming. It now extends far beyond what Congress originally intended – which was a procedural statute requiring federal agencies to assess the environmental, social, and economic impacts of proposed major federal actions.

The Environmental Case For Reforming NEPA

This week ConservAmerica co-hosted a teleconference with the Federalist Society to discuss the Trump administration’s proposal to revise regulations governing the National Environmental Policy Act. ConservAmerica is aligned with many who have called for NEPA reform, first, because we believe it is essential to have a rational, well-functioning environmental review process that helps to focus agencies on those issues that matter most. And, second, because our nation’s robust environmental protections and standards exist because of a strong economy, not in spite of it.
